Les fonds de Private Equity se sont beaucoup dvelopps et ils cherchent investir dans tout projet porteur : dans lagrobusiness, la grande distribution, les services financiers, etc. Et cela va aller croissant. Il y a de plus en plus de fonds dinvestissement qui constituent une alternative au financement bancaire et cest souvent plus adapt aux besoins de nos pays. Mieux, ce sont des fonds qui, en plus de mettre de largent sur la table, sinvestissent au quotidien auprs des managers pour les aider excuter des business plans 3, 5, voire 10 ans. Sur ce point, il y a donc un effort de pdagogie qui est trs bnfique par rapport aux banques classiques. il existe aujourdhui de nouvelles banques et une nouvelle gnration de professionnels de la banque qui cherchent proposer des solutions adaptes aux entreprises.<br />
En droit des affaires, toute intervention du lgislateur ou du rgulateur doit tre mesure et prise sur la base dune analyse prcise de ce que cela entranera du point de vue conomique. Lenjeu est danalyser ltat du droit par rapport aux besoins conomiques que le droit est cens servir. Encadrer la pratique des affaires et promouvoir ainsi lactivit conomique, tel est aussi le rle de facilitateur de lavocat daffaires lorsquil aide lautorit publique amliorer le cadre des affaires.<br />
Identifier les individus ayant besoin de conseils et former les avocats bnvoles pour les reprsentations pro bono qu'ils choisissent de prendre.<br />

Le PPP constitue lexemple mme de la mode intellectuelle dans le domaine juridique. Mais, clairement, lhritage du droit public franais et du modle franais en matire juridique est considr, du point de vue des acteurs conomiques, comme rigide dans la mesure o il fait une large part aux prrogatives de la personne publique et nest pas assez pragmatique par rapport au modle anglo-saxon. Cette comparaison des deux modles se rplique par rapport la pratique de lEtat dans ces deux environnements. Il y aurait un pragmatisme plus prononc dans les pays anglophones. En droit public francophone, la ralit conomique de lintervention de la personne publique dans le champ conomique est apprhende travers des catgories juridiques rigides (concession, affermage, gestion dlgue, etc). Dans lapproche anglo-saxonne, on na pas ces catgories ; on cherche plutt apprhender les projets dans ce quils ont de particulier au lieu de recourir des catgories pr-tablies lintrieur desquelles on cherche faire rentrer des ralits conomiques. Mais tout cela est entrain dvoluer rapidement grce notamment aux efforts entrepris dans le cadre de lOHADA pour rendre plus attractives les rgions CEMAC et UEMOA pour les investisseurs privs.
Les chaines d'approvisionnement des entreprises sont de plus en plus scrutes, ce qui met en avant le rle du secteur priv en combattant la criminalit, lexploitation et la torture. Ces problmatiques sont surtout prsentes sur les lieux de conflits ou dpourvus dtat de droit. Les cabinets d'avocats et les juristes peuvent jouer un rle important dans le dveloppement de la dontologie et du respect de l'thique juridique.<br />

Lenvironnement juridique doit tre adapt aux besoins des investisseurs locaux et internationaux. Ce cadre est administr et nourri par des praticiens du droit des affaires qui, grce leur prise directe sur la vie des affaires, insufflent lesprit dinnovation et la sophistication ncessaire pour apporter des rponses aux questions qui se posent dans le milieu des affaires.
