Supporting a legislation to implement the right to food

    Intro

    In order to achieve SDG 2 legislative support is essential, in particular to establish the principles of the right to adequate food and to establish coordination mechanisms. FAO supported a process in Cabo Verde for the legislative drafting and capacity development among government and civil society on the right to food.

    Implementation of the Project/Activity

    In 2015, the National Strategy on Food and Nutrition Security – 2020 (ENSAN- 2020) was approved. With the support of FAO, the country prepared a conceptual framework for the National School Feeding Programme. The framework had a strong component on nutrition education and adopted specific targets (i.e. 25% of public procurement for school feeding should come from local food producers) which helped increasing linkages with local producers and the production sector (i.e. aquaculture). This greatly improved the overall capacity to produce and supply nutritious food the school feeding programmes. The formulation of a CNSAN Plan of Action 2014-2016 resulted in the creation of a Technical Commission mandated to work on the elaboration of a National Law on Food and Nutrition Security, in the context of the Right to Food. Over the course of two years, the work of the Commission led to the adoption of the Law No. 37/IX/2018 which, defines and guarantees the right to adequate food for all, while establishing the principles, norms and proceedings to guarantee its implementation as well as of the national food and nutrition security policy.

    Results/Outputs/Impacts

    The result is the adoption of Law No. 37/IX/2018 approving the principles, norms and procedures that guarantee the recognition and effective exercise of the Human Right to Adequate Food and defining the guiding principles of the Food and Nutrition Security policy.

    Enabling factors and constraints

    Preparing the draft legislation with the Ministry of Agriculture was the core of the activity. Ensuring capacity development of the food security council and civil society was instrumental in building the political support necessary for the legislation to be adopted in 2018. Furthermore, engagement with Lusophone countries in Africa at the political level also supported the strengthening of the political will necessary.

    Sustainability and replicability

    Working on multiple fronts, with government, parliamentarians and civil society helps strengthen the joint political will to adopt and implement legislation towards achieving zero hunger.

    COVID-19 Impact

    The existence of coordination mechanisms, legal principles and a framework for implementing the right to food is highly relevant in case of emergencies such as pandemics.
