Description
En 2017, durante el segundo mandato de la ex presidenta Michelle Bachelet, se presentó una iniciativa en el parlamento en Chile con el propósito de prevenir, castigar y eliminar la violencia dirigida hacia las mujeres. En mayo de 2023 se amplió la iniciativa para incluir a niños, niñas y adolescentes como víctimas directas de la violencia de género. Además, se consideró a las niñas y adolescentes como personas que sufren violencia de género y que necesitan una representación legal especializada. Esta medida tiene como objeto “prevenir, sancionar y erradicar la violencia contra las mujeres, cualquiera sea su edad, estado civil, etnia, idioma, religión o creencia, ideología u opinión política, o de otro tipo, origen nacional o social, filiación, situación socioeconómica, situación laboral, nivel educacional, de embarazo, orientación sexual, identidad y expresión de género, apariencia, condición de salud, de migrante o de refugiada, discapacidad de cualquier tipo o cualquier otra condición”. También establece los deberes de los órganos del Estado en materia de prevención, investigación protección, sanción y reparación de violencia contra la mujer y dispone medidas generales de prevención de la violencia contra la mujer en el ámbito de la educación y la seguridad pública. Con el objetivo de avanzar en la tramitación del proyecto, que hoy se encuentra en su segundo trámite constitucional, en conmemoración del 8 de marzo de 2023, el Ministerio de Interior y Seguridad Pública se sumó a la tramitación. Adicionalmente, el 23 de agosto el Jefe de Estado renovó la urgencia Suma del proyecto.
El Proyecto de ley sobre el derecho de las mujeres a una vida libre de violencia se tramita conjuntamente por las Comisiones de Constitución, Legislación, Justicia y Reglamento y de la Mujer y Equidad de Género del Senado
